The 21-year-old was issued with future court attendance notices following police investigations into the accident between Leeton and Yanco.
Police and emergency services were called to the collision on Back Yanco Road about 7pm last Tuesday when a Holden Barina collided with a Holden Cruze at the intersection with Research Road.
The Barina ended up coming to rest in an irrigation canal, with both occupants trapped in the vehicle and unconscious.
With Rural Fire Service members directing traffic away from the scene, Leeton VRA Rescue Squad released the two men from the vehicle and they were conveyed first to Wagga and then St George hospitals for treatment.
The passenger of the Barina suffered serious injuries and remained on the critical list for some days.
The driver of the Cruze was assessed at Leeton hospital and released the same day.
Griffith Local Area Command crime manager Detective Inspector Paul Smith said an investigation by detectives and forensic services resulted in the driver of the Barina being interviewed in Sydney today.
He will front Narrandera Local Court on December 19 to answer charges of dangerous driving occasioning grievous bodily harm and negligent driving occasioning grievous bodily harm.
