Before 6 o'clock last night, Griffith Highway Patrol units stopped a 42-year-old man driving down Conapaira Street in Whitton.
Both the driver and his passenger were found not to be wearing seatbelts.
Upon approach the police reported detecting the strong odour of intoxicating liquor emitting the cabin of the vehicle.
The driver was submitted to a roadside breath test, which returned a reading of 0.288. The driver allegedly replied "I'm over".
He was arrested at the scene and conveyed to Leeton Police Station, where he submitted to an additional breath analysis. It returned a reading of 0.314, to which the driver allegedly replied "That's mad".
The driver will appear before Leeton Local Court in September, charged with high range PCA and seatbelt offences.
His licence has also been suspended.
Meanwhile the passenger received an infringement notice for not wearing a seatbelt.
