Leeton police were travelling west on Henry Lawson Drive when they came across a Toyota Hilux also being driven west around 11.45pm.
Police said the car didn't have any active taillights.
The Hilux stopped to let a passenger out and police approached a 23-year-old man and asked him if he was the driver, and if he was aware that the taillights were not active.
Officers said the man initially denied having drank any alcohol, but admitted to having 'had a few' before being given a roadside breath test, which was positive.
Officers took the man to Leeton police station where he returned a breath analysis reading of 0.097 and was taken to Leeton District Hospital for a blood test.
The driver is expected to face Leeton Local Court at a later date.
